New mechanisms for the protection of constitutional rights to be implemented

On December 17, President Shavkat Mirziyoyev reviewed a presentation on improving mechanisms to protect the constitutional rights of citizens and entrepreneurs, as well as on digitizing the Constitutional Court’s activities.

 

In recent years, several measures have been implemented to improve the Constitutional Court’s efficiency, as it celebrates its 30th anniversary this year. In 2021, a new version of the law on the Constitutional Court was adopted, enabling the establishment of an effective system of constitutional control.

At the same time, it was emphasized that ensuring full implementation of the Constitutional Court’s powers remains a priority and requires advancing the reforms in this direction to the next stage.

Relevant proposals were considered at the presentation.

In particular, it is intended to strengthen the implementation of the Constitutional Court’s annual proposals and recommendations to enhance constitutional legality in the country.

In addition, the procedures for considering appeals from citizens and entrepreneurs by the Constitutional Court will be optimized, and bureaucratic obstacles will be removed.

To increase the effectiveness of constitutional complaints and ensure judicial protection for applicants, it was also proposed to introduce a procedure under which a court’s finding that a law is unconstitutional would serve as a basis for review of the relevant judicial act.

Particular attention was paid during the presentation to digitizing the Constitutional Court’s activities to improve public access.

In particular, it is planned to introduce remote participation in court hearings, broadcast hearings online, and establish electronic information exchange between ministries and departments. As part of the court’s presidency of the Asian Association of Constitutional Courts, several international events are planned to be held in the country and abroad.

The importance of enhancing the Constitutional Court’s authority in the international arena and strengthening cooperation with the constitutional courts of other states was emphasized.

Other issues related to the administration of justice were also considered, including measures to bring economic and administrative courts closer to the population and entrepreneurs. An initiative was proposed to determine extraterritorial jurisdiction when filing with these courts automatically.

The President of Uzbekistan supported the proposals presented and instructed the responsible officials to ensure their high-quality, systematic implementation.
